1. Acceptance of Terms

By purchasing, downloading, or using any house plan from Waddell & Willcutt Architecture, you agree to these Terms & Conditions. If you do not agree, please do not proceed with purchase or use of the plans.

2. About Our Plans

Waddell & Willcutt Architecture offers thoughtfully designed, pre-drawn residential plans intended to serve as a strong foundation for your home.

These plans are developed as builder’s sets and are not tailored to a specific property, jurisdiction, or set of site conditions. Because every build is unique, additional review and coordination will be required prior to construction.

3. Delivery & Processing

All plans are delivered in PDF format only. No editable or CAD files are included.

Each plan is carefully reviewed prior to release as part of our commitment to quality and accuracy. Please allow 1–3 weeks for delivery following purchase.

Plans will be delivered electronically via email or secure download. It is the purchaser’s responsibility to provide accurate contact information and retain copies of all files.

4. License for Use

Your purchase grants a limited, non-exclusive, non-transferable license to construct one (1) single-family residence from the selected design.

If additional builds are desired, a separate license must be obtained for each structure.

This license allows you to build the home—it does not transfer ownership of the design.

5. Responsible Use of Plans

To protect the integrity of our work, the following uses are not permitted without written approval:

  • Reusing the plans for multiple builds
  • Sharing, distributing, or reselling the plans
  • Using the design for large-scale or repeated development
  • Presenting the design as your own work
  • Using the plans for multi-family or commercial projects

These guidelines apply to all purchasers, including homeowners, builders, and developers.

6. Modifications & Additional Services

We understand that many projects require adjustments. Modifications are available through Waddell & Willcutt Architecture under a separate agreement.

  • All revisions are issued as updated PDF documents
  • Stock plan purchases do not include site-specific services
  • Waddell & Willcutt Architecture is not acting as Architect of Record

Modifications made by others, or use of altered plans without approval, release Waddell & Willcutt Architecture from responsibility.

7. Local Review & Compliance

Building requirements vary by location. Prior to construction, plans should be reviewed and adapted by a licensed professional familiar with your local jurisdiction.

The purchaser is responsible for ensuring:

  • Compliance with applicable building codes
  • Zoning and permitting approval
  • Structural and engineering coordination
  • Suitability for site-specific conditions

While our plans are carefully developed, approval by local authorities is not guaranteed.

8. Project Responsibility

Purchase of a stock plan does not establish a full architectural services relationship.

Waddell & Willcutt Architecture does not provide:

  • Construction administration
  • Site visits or inspections
  • Contractor coordination
  • Field verification

9. Intellectual Property

All plans and design materials remain the intellectual property of Waddell & Willcutt Architecture and are protected by copyright law.

Your purchase provides a license to use the design—it does not grant ownership of the work.

10. Limitation of Liability

To the fullest extent permitted by law, Waddell & Willcutt Architecture shall not be liable for damages resulting from the use of these plans, including:

  • Construction errors or omissions
  • Permit denials or delays
  • Code or regulatory issues
  • Project delays or cost overruns

Use of the plans is at the purchaser’s discretion and risk.

11. Indemnification

You agree to indemnify and hold harmless Waddell & Willcutt Architecture from any claims, damages, or expenses resulting from:

  • Improper or unauthorized use of the plans
  • Modifications made without approval
  • Failure to comply with applicable regulations

12. Sales Policy

Due to the digital and intellectual nature of our work, all plan sales are final.

We encourage you to carefully review all plan details and consult with your builder or design professional prior to purchase to ensure the design aligns with your goals.

13. Updates to Terms

Waddell & Willcutt Architecture may update these Terms & Conditions from time to time. Continued use of the plans constitutes acceptance of the current version.

14. Governing Law

These Terms & Conditions are governed by the laws of the State of Mississippi.
